(intro music) (who can file a wrong lawsuit in Ohio?)
Hi, I'm Mike
Bruno with the Boyk Law Office in Toledo and the question is who may file
a wrongful death claim?
In the state of Ohio a wrongful death claim can
only be filed by a personal representative
from the deceased person's estate. That is if the person died
with a will you would have an executor
that was named in that will and appointed by the probate judge.
If the person died without a will then you would have to file an application
with the probate court to become the
administrator of the estate so these are the people
who stand in the shoes of the deceased person and have the legal authority to
file
in court a wrongful death action.
