teachers talking about the second amendment is a very very different and
teachers talking about the fifth amendment here's a really interesting
story
a high school teacher named john dryden independent illinois
could be disciplined for telling his students that they have fifth amendment
rights before he gave the most a survey that school officials
wanted to used to gauge the emotional needs of the students okay
the survey included a lot of questions about drug and alcohol use
and the bit aditya maybe it's became via have to admit i'm not sure if it's
batavia herbert idea
the daily herald in that town reported uh... just a couple of days ago
the teacher john dryden advice students of the right not to incriminate
themselves before giving them a screener survey
which had each student's name printed on in other words this was not an anonymous
survey
dryden said to the herald
i made a judgment call
there was no time to ask anyone
and he could be issued a letter of remedy which would stay in his
employment record ican by fetches ability to get future teaching jobs et
cetera and um... brad new correct was the chief academic off officer of the
county a public school district one oh one
told the same newspaper that the survey aspirants about their emotions and about
use of drugs alcohol and tobacco
the answers were then going to be reviewed by social workers school
counselors and psychologist the survey was purchased from a private company
called multi health systems inc
and did not provide a copy
saying it great uh... that the school didn't provide a copy to the media
saying it had some proprietary information on it
this is this is interesting because the driving told like a former student for
example joburg el nino
about the possibility of sanctions against him which prompted brutality oda
creating online petition defending dryden
and people are on all sides of this issue right
question one is alright just stating the fact that the fifth amendment exists and
what people's rights are doesn't change of whether people have or don't have
those rights is principal like a miranda warning does not determine whether the
person has those rights it near that merely indicates whether they've been
advised that they have them
in the same way could we imagine the teacher saying
hey guys the second amendment exists just so you know we have a
constitutionally protected right to bear arms
the other issue is
whether it was really his place or not and who's place it was to be saying
whatever but in any case
amaya wrong at the fundamental thing here is that he's being punished simply
for stating something which is accurate you'd the fifth amendment does exist
it seems like
that's what they're trying to punish him for
uh... now if
if this test was mandatory and he's not actually uh... a constitutional issue
uh... which i'm not commenting on that but if that's the case then maybe the
school does have some
to uh... to you know will but if it is mandatory should they not have
past teachers for permission how can you force students without parental
permission minors in most cases
to answer about drug and alcohol use what's your view on it and sign bombing
it did the surveys one anonymous and uh... apparently
parents didn't give their consent so you're basically asking minors
without their parents' consenting to a whether they've engaged in illegal
activity now
they can then say or we're not going to give the salon forstmann it will never
be used against them legally

that's a separate issue from the fifth amendment thing in other words the
future was just explaining what the fifth amendment is
it is true that it's kind of irrelevant to this in the sense that
for me it would have been more than enough for the teacher just to say hey
kids like
you'd only have to answer this uh... if your parents didn't consent to a real
problem i have with you with that the problem i have with that is that that
might be that it may be mandatory from the point of view of the school
and by saying that the teacher may actually be doing something which is
directly going against school policy simply state even if it's not relevant
like what you're saying is the fifth amendment may not really be what applies
here but even if it doesn't stating that the fifth amendment exists
does not directly by late school you will agree with that
yet ready with a degree *** very interesting story send me your thoughts
