TORT Claim
in Ontario following a motor vehicle accident
you can make a claim for accident benefit through your own insurer
this could be made by anyone injured in an accident
regardless of fault. A TORT claim on the other hand can only be made
if you are the victim of another persons negligence subject to statutory
threshhold and deductable. In a car accident
you cannot make a TORT Claim if you are 100 percent responsible for the accident
in a tort action we can pursue damages for pain and suffering
out-of-pocket expenses past and future loss of income
and loss of competitive advantage. There is a provision in the law which requires
that your own insurer step into the shoes
of the at fault uninsured or unidentified party
