So what are your rights if you've been injured on the job?
Hi, I'm Dan Pruitt, a Workers' Comp Injury Lawyer in Greenville, South Carolina.
The statutes create a cause of action for you,
if you have been injury by accident arising from the course in scope of
your employment. All of a sudden it sounds like very
lawyerly language. It simply means that you are at work,
something unexpected happened, such as you get hit by a forklift,
and it causes you injury. It could be injury to your back, could be injury to your brain,
could be injury to your spinal cord, or any part of your body.
ultimately you're supposed to be able to receive
your medical bills, and if you're out of work for certain periods on
you're supposed to get your lost wages while you're out of work.
In any case, if you have permanent injury,
you're entitled to receive an award of either partial disability,
or total disability, depending on the condition that you find yourself in
when the doctors have said you've gotten as good as you're going to get,
when you've healed as well as you're going to heal. At that point,
how do you determine what amount of money you should get for your disability?
There are at least three different theories for determining
disability in South Carolina.
First, each body part has been assigned a number of weeks
for the total loss. So, if you've experienced a partial loss,
I'll some body part then you deserve to receive
disability in a partial amount. If you've received a total loss,
then you should receive total disability, as the statute sets forth.
But what if you have more than one part of your body affected by the workers'
comp accident?
Well, let's just say you have a back injury,
with pain radiating down into your leg.
That's both an injury to the back and an injury to the neck.
You may be able to obtain disability
under a total disability theory, if you're not able to return to the type of
work that you were doing before,
and you cannot reasonably expect the expected to return to any type of work.
Or, if you have returned to some type of work but are making less money that you
were making before,
you may be able to prove that you had a specific wage loss.
