Jason: Good morning, welcome to another edition of Getting Legal with Misny. We're
here
at our favorite place, the Diner on Fifty-fifth.
Tim, we've been discussing mediation. Tim: Yes.
Jason: And you're a big proponent of mediation. Tim: Yes, I am. Jason: Why is that?
Tim: Because it's a very effective tool in resolving a case where there's a dispute
with the insurance company,
quickly and for true value.
Jason: And just in case people have missed a couple of our other mediation
segments, this is where
you would sit down with the other party outside of the legal system or
even take it outside of legal system. Sometimes it comes to a faster resolution
and a better one. Tim: Exactly right. Typically
both parties agree on a mediator, and oftentimes it's a retired judge. Someone
who has a lot of experience in negotiating cases and can oftentimes
predicts
how a case would go, if it had to go to trial. So
a very good mediator
oftentimes can get a case resolved. Jason: Now if I have been injured, Tim: Yes,
Jason: and I'm approached. Would I ever be approached by like an insurance company? If I haven't sought out legal representation to mediate
myself? Tim: Absolutely not. That is a great question, Jason.
The insurance company isn't going to negotiate with you.
They will offer you
an amount of money
to get the case resolved quickly
and usually,
it is a fraction
of the true value
of the case Jason: Why?
Tim: Because the insurance company
assumes, you don't know what these cases are worth.
Typically, you don't have the resources to take the case to mediation. If someone tried to mediate
or try the case himself, he would kind of like
tried to remove one's gallbladder at home in the kitchen table. It's gonna
get real messy and you're not gonna like the results.
